The issue on appeal involve the disbursement of bond proceeds to the prevailing party on appeal.   Common sense would dictate that the prevailing party would be entitled to the bond proceeds which were posted for their protection; however, the specific issue presented to the Court relating to the marketability of the property with pending litigation had not previously been before the Court.
